Can and will happen. Unless the remainder of the season sets up to plate, The Dark Knight is going to outshine the competition for miles. This is where I see the top 5, along with 5 runner ups

Australia needs reviews. Milk has been getting good reviews since the premiere, Slumdog Millionaire is still at 90 something percent on RT, Benjamin Button is supposedly getting a lot of buzz. Revolutionary Road is generating interest. So far, The Dark Knight and Slumdog Millionaire are the only two that seem safe at this point.

I fully agree with neo78056 as my early picks for Best Picture are: The Dar Knight, Curious Case of Benjamin Button, Slumdog Millionaire, Milk, and Revolutionary Road.
But I really don't believe The Dark Knight will win. It'll be the public favorite since it'll be the most viewed film of the nominees (just like Juno last year), but I can't see TDK taking home the award.
This film is overrated! I like it...but the best picture of the year? no...a nomination for Best picture yes...
WALL-E was the most critically acclaimed movie of the year, it deserves a nomination...
I think Rotten Tomatoes is not good for Oscar predicting…Changeling was great...56% RT! 8.1 imdb...

The Hollywood Reporter’s review is a bit negative… Variety: Revolutionary Road” is a very good bigscreen adaptation……Winslet’s perf is less surprising….”

Wall-E, while great, is not going to be nominated for Best Picture. Here's why.
When the Academy created the Best Animated Feature Category, it was for two big reasons.
1. The backlash from film purists who were up in arms about Beauty and the Beast being nominated for Best Picture.
2. So that great films like Wall-E and other great animated films would not have to compete with live action films. If they put Wall-E in the Best Picture shortlist, it would never have a snowball's chance in hell of winning. But in the Best Animated Feature category, it can still win a prestigious award without having to deal with voter prejudice against animated films.
Plus, if they nominated it for both, it would basically be like admitting that their categories were redundant an unnecessary, and would completely undermine the point of having a Best Animated Feature category in the first place. Isn't it better that The Dark Knight AND Wall-E can be nominated for oscars, rather than having to choose between one or the other? Buzz is also important, and honestly, despite the FYC ads and dvd release this week, the Best Picture buzz is fading faster than a speeding bullet. Critics talked about it initially, but I haven't heard a peep about it since. The Dark Knight, on the other hand, is still being talked about, more than three months since the film's release. Plus, the dvd will be released in early December, as well as a theatrical re-release just before oscar ballouts are cast. The Dark Knight will be nominated for Best Picture, end of story.
my only main issue with the arguement against WALL-E is that if a foreign film can be nominated in the foreign film category and for Best Picture, why can't an animated film do so as well?
A good point, but the foreign language category has been around for a lot longer than the animated film category, and as we've seen before, only very rarely has a foreign film been nominated in both categories (Crouching Tiger, Hidden Dragon was the last one I can remember).
However, the foreign language film category is so screwy in its eligibility process and whatnot that its hard to make an argument about the logic of nominations using the foreign language film category as a reliable example.
Whether or not it should happen, I don't think it will. Remember - they voted Shakespeare in Love best picture a few years back.
And then, who would have thought Gangs of New York, Lord of the Rings: The Two Towers, The Pianist or The Hours, would lose out to Chicago for Best Picture!
